Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the 369 Rituals mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms are a legal agreement between you and Matthew Davis trading as 369 Rituals ("369 Rituals", "we", "us", "our"), a sole trader registered in England.

2. About the App

369 Rituals is a health and wellness application designed to support mindfulness, intention-setting, and daily ritual practices. The App provides guided rituals, tracking tools, and motivational content to support your personal wellbeing journey.

3. Eligibility

You must be at least 13 years of age (or 16 in the UK/EEA) to use the App. By using the App you confirm that you meet this requirement. If you are under 18, you confirm that your parent or legal guardian has consented to these Terms on your behalf.

4. Subscriptions and Billing

The App offers optional auto-renewable subscriptions that unlock premium features. The following terms apply:

  • Subscription fees are charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours before the end of the current period at the then-current subscription price.
  • To manage or cancel your subscription: go to Settings → [Your Name] → Subscriptions on your device.
  • No refund is provided for the unused portion of a subscription period.
  • To request a refund, visit reportaproblem.apple.com.

5. Intellectual Property

All content within the App — including text, graphics, logos, audio, video, ritual programmes, and software — is owned by or licensed to 369 Rituals and is protected by copyright, trade mark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any App content without our express written permission.

6. Licence to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device(s) solely for your own personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to: sublicense, sell, or commercially exploit the App; reverse-engineer or decompile the App; or use the App to develop competing products or services.

7. User Conduct

You agree not to use the App to: violate any applicable law or regulation; infringe any intellectual property or privacy rights; transmit any harmful, offensive, or unlawful content; attempt to gain unauthorised access to our systems; or interfere with the App's normal operation.

8. Health and Wellness Disclaimer

The App provides general wellness and mindfulness content for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical or mental health condition.

9. Third-Party Services

The App integrates with third-party services including RevenueCat (subscription management) and Apple services. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of these third-party providers.

10. Modifications to the App

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, 369 Rituals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the greater of: (a) the total amount you paid to us in the 12 months preceding the claim; or (b) £10.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Apple App Store — Additional Terms

These Terms are agreed between you and 369 Rituals only. Apple is not a party to these Terms and is not responsible for the App or its content. Apple has no obligation whatsoever to provide any maintenance or support services with respect to the App.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party intellectual property infringement claim relating to the App.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary thereof.

13. Indemnification

You agree to indemnify and hold harmless 369 Rituals, its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

14. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 369 Rituals regarding the App and supersede all prior agreements, representations, and understandings relating to the same subject matter.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. You and 369 Rituals agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute arising out of or in connection with these Terms, except that if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local court.
